Terms of Service
These Terms of Service ("Terms") govern your use of the PingClass platform ("PingClass", "we", "our"). By creating an account or using the service, you agree to these Terms and to our Privacy Policy.
1. The service
PingClass provides fee management, student, attendance and communication tools for tuition centers and coaching institutes. Features may vary by plan as shown on our pricing page.
2. Accounts
- You must provide accurate information when creating an account.
- You are responsible for safeguarding your login credentials and for activity under your account.
- Accounts may be assigned admin, teacher or parent roles with different permissions.
- You must be at least 18 years of age to create an account. If you create an account on behalf of an organization, you represent that you are authorized to bind it.
3. Institute responsibilities and data
In respect of student and parent data you enter, your institute is the Data Fiduciary under the Digital Personal Data Protection Act, 2023. You agree to:
- Provide a privacy notice to students and parents before their data is collected through PingClass.
- Obtain verifiable parental consent before processing data of children below 18 years of age.
- Use data only for the purposes for which it was collected, and honour requests for access, correction and erasure.
- Only enter data you are lawfully entitled to process.
PingClass processes this data as a Data Processor on your instructions, as further described in our Privacy Policy.
4. Acceptable use
- You will not misuse the service, attempt to access data you are not authorized to see, or interfere with the platform.
- You will not upload unlawful or infringing content.
- You will not resell the service without our written consent.
5. Fees and payments
Paid plans are billed through our payment provider (Razorpay). Fees are as described on the pricing page at the time of purchase. You authorize us to charge the applicable fees. Refunds, if any, are handled on a case-by-case basis.
6. Intellectual property
The PingClass software, design and content are owned by PingClass and are protected by law. We grant you a limited, non-exclusive, non-transferable right to use the service for your internal purposes. Your data remains yours.
7. Availability and liability
- We aim to keep the service available and reliable but do not guarantee uninterrupted or error-free operation.
- The service is provided "as is". To the maximum extent permitted by law, our total liability for any claim is limited to the fees you paid in the six months before the claim.
- Nothing in these Terms limits liability that cannot be excluded by law.
8. Security incidents
If a data breach affects your data, we will notify you in line with the Digital Personal Data Protection Act, 2023 and help you meet your notification obligations.
9. Termination
- You may stop using the service and close your account at any time.
- We may suspend or terminate access for breach of these Terms, with notice where practicable.
- On termination, your data will be deleted or returned as you direct, subject to legal obligations.
10. Changes to these Terms
We may update these Terms from time to time. Continued use of the service after changes take effect constitutes acceptance. The "Last updated" date above reflects the latest version.
11. Governing law
These Terms are governed by the laws of India. Disputes will be subject to the jurisdiction of the courts of India.
